The arbitration will take place in the Commonwealth of Pennsylvania, USA, or at another location mutually agreed upon, and will be conducted in English. Fees will be allocated in accordance with the AAA Consumer Arbitration Rules. If the arbitrator finds that a claim was brought in bad faith or for an improper purpose, fee allocation may be adjusted accordingly.
CLASS ACTION AND JURY TRIAL WAIVER: YOU UNDERSTAND AND AGREE THAT, BY AGREEING TO ARBITRATION, YOU AND PARC DECOR ARE EACH WAIVING THE RIGHT TO SUE IN COURT AND THE RIGHT TO A TRIAL BY JURY. You and Parc Decor agree that any proceedings to resolve or litigate any dispute will be conducted solely on an individual basis. Neither you nor Parc Decor will seek to have any dispute heard as a class action, representative action, collective action, or private attorney general action.
Governing Law: These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, USA, without regard to its conflict of law principles.
Exceptions: Either party may seek relief in a small claims court for disputes within the scope of that court's jurisdiction. Claims involving intellectual property infringement may be brought directly in court.
Limitation on Time to File Claims: To the extent permitted by applicable law, any claim or cause of action arising out of or related to your use of the Service or these Terms must be filed within one (1) year after such claim or cause of action arose; otherwise, it is permanently barred.

During a Force Majeure Event, our obligations under these Terms will be suspended to the extent and for the duration that they are affected. We will make reasonable efforts to resume performance as soon as the Force Majeure Event is resolved. If a Force Majeure Event continues for longer than thirty (30) days, either you or Parc Decor may terminate any affected orders by providing written notice. In such event, any prepaid amounts for undelivered products will be refunded.
